What w8v is

w8v is an underground electronic music marketplace operated by w8v, based in Spain. It lets artists and labels sell music directly to fans, with automatic revenue splits paid out via Stripe Connect.

By creating an account or purchasing music on w8v, you agree to these terms. If you do not agree, do not use the platform.

Accounts

You must be at least 18 years old to create an account. You are responsible for keeping your login credentials secure and for all activity that occurs under your account. If you suspect unauthorised access, contact us at info@w8v.io immediately.

You may not create accounts for the purpose of manipulation, fake follower counts, or circumventing a previous ban.

For fans — buying music

When you purchase a track or album on w8v, you receive a non-exclusive, non-transferable licence to stream and download that music for personal, non-commercial use. You do not acquire ownership of the underlying copyright.

Right of withdrawal

Under EU Directive 2011/83/EU on consumer rights, you have a 14-day right of withdrawal on digital purchases — unless you have already started downloading or streaming the content and explicitly consented to waive that right. By completing a purchase on w8v and accessing your download, you acknowledge that the right of withdrawal no longer applies to that purchase.

If you have a genuine complaint about a purchase before accessing the content, contact us at info@w8v.io and we will handle it fairly.

For artists and labels — selling music

By uploading a release to w8v, you confirm that:

• —You own or have all necessary rights to the music, artwork, and any samples used.
• —The content does not infringe any third-party copyright, trademark, or other intellectual property right.
• —The content does not violate any applicable law.
• —You have the legal right to sell the music in the territories where w8v operates.

You grant w8v a limited, non-exclusive licence to host, display, and distribute your content through w8v solely for the purpose of operating the platform. We do not claim ownership of your music.

Revenue splits are configured by you at upload time. Once a sale occurs, the split is final and cannot be retroactively changed for that transaction. Removing a collaborator from a split stops future distributions to them but does not affect amounts already earned.

Payments and fees

All payments are processed by Stripe. By using the payment features you agree to Stripe's Terms of Service.

w8v charges a platform fee on each sale. The current fee is displayed on the upload and dashboard pages. The remainder is distributed to the artist and any configured revenue-split collaborators via Stripe Connect.

Payouts are subject to Stripe's minimum payout thresholds and any identity verification requirements Stripe imposes. w8v is not liable for delays caused by Stripe's processes.

Prohibited content and conduct

You must not use w8v to:

• —Upload music or artwork you do not have the right to sell.
• —Upload content that is illegal, hateful, threatening, or sexually exploitative.
• —Attempt to circumvent any payment, DRM, or security mechanism.
• —Scrape, crawl, or systematically extract data from the platform without permission.
• —Impersonate another artist, label, or user.
• —Use the platform to launder money or conduct fraudulent transactions.

We reserve the right to remove content, suspend, or permanently ban any account that violates these terms without prior notice.

Intellectual property

All content you upload remains yours. You retain full ownership of your music and artwork.

The w8v platform itself — its design, code, branding, and name — is owned by w8v. You may not copy, reproduce, or create derivative works from it without written permission.

Platform availability

We aim to keep w8v available at all times but cannot guarantee uninterrupted access. We may take the platform offline for maintenance, updates, or reasons outside our control. We are not liable for any loss caused by downtime.

Limitation of liability

To the fullest extent permitted by Spanish and EU law, w8v is not liable for any indirect, incidental, or consequential damages arising from your use of the platform, including lost revenue, lost data, or loss of goodwill.

Our total liability for any claim arising from these terms is limited to the amounts you paid to w8v in the three months preceding the claim, or €100 — whichever is greater. Nothing in these terms limits liability for fraud, death, or personal injury caused by our negligence, as required by applicable law.

Account termination

You may delete your account at any time from your settings page. We may suspend or terminate accounts that violate these terms. Upon termination, your profile and content are removed from public view. Purchase records are retained as required by law.

Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you by email at least 14 days before they take effect. Continued use of the platform after that date constitutes acceptance of the new terms.

Governing law and disputes

These terms are governed by the laws of Spain. Any dispute that cannot be resolved informally will be subject to the jurisdiction of the courts of Spain, without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence.

EU residents may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
